1. The Service
Playtest.ai lets game studios run playtests, capture play sessions, and turn them into deduplicated, evidence-backed issues. Studios create projects and invite playtesters; playtesters run an assigned build and share their session.
2. Accounts
To use studio features you must create an account and keep your credentials secure. You are responsible for activity under your account. You must provide accurate information and be at least 16 years old (or the age of digital consent in your jurisdiction).
3. Playtesters and consent
Playtesters participate by invitation. Before any session is captured, the Service shows exactly what will be recorded (which may include the game window, camera, microphone, and input) and captures your consent. Optional streams are opt-in, and you may decline them or stop a session at any time. Reviewing a session is limited to the studio that invited you; playtesters never gain access to a studio’s other data.
4. Content and ownership
Studio content
As between you and us, studios retain ownership of the game builds they upload and of the analysis and issues produced from their playtests (“Studio Content”). You grant Playtest.ai a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, analyze, and use Studio Content to operate, provide, improve, and develop the Service.
Session recordings
Playtesters grant the inviting studio and Playtest.ai a worldwide, royalty-free license to capture, store, process, analyze, and use their session to provide, improve, and develop the Service, as described at the time of consent and in our Privacy Policy. We may create and use aggregated or de-identified data without restriction.
5. Acceptable use
You agree not to:
- Upload malware, or builds you do not have the right to distribute. Uploaded builds are screened before distribution.
- Attempt to access accounts, data, or systems you are not authorized to access, or interfere with the Service’s operation or security.
- Reverse engineer, resell, or misuse the Service except as permitted by law.
- Use the Service to violate the rights of others or any law.
6. Intellectual property
The Service, including its software, design, and branding, is owned by Playtest.ai and protected by intellectual property laws. These Terms grant you a limited, non-exclusive, non-transferable right to use the Service; they do not transfer any ownership in the Service to you.
7. Third-party services
The Service relies on third-party providers (including for authentication, hosting, storage, database, and AI transcription and analysis). Your use of the Service may be subject to their terms, and we are not responsible for third-party services.
8. Disclaimers
The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. AI-generated transcripts and analysis may contain errors and should be reviewed before you rely on them.
9. Limitation of liability
To the maximum extent permitted by law, Playtest.ai will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, revenue, or profits, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the twelve months before the claim.
10. Indemnification
You will indemnify and hold harmless Playtest.ai and its affiliates, officers, and employees from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your content, your use of the Service, or your violation of these Terms or any law or third-party right.
11. Termination
You may stop using the Service at any time. We may suspend or terminate access at any time, with or without notice, if you violate these Terms, or to protect the Service or our interests. Provisions that by their nature should survive termination will survive.
12. Changes
We may update these Terms from time to time. Material changes will be reflected by the “Last updated” date above, and continued use of the Service after changes take effect constitutes acceptance.
13. Governing law
These Terms are governed by the laws of the jurisdiction in which Playtest.ai is established, without regard to conflict-of-laws rules.
